Terms of Service

Moadaty ("us", "we", or "our") operates the moadaty.com website (the "Service"). This page informs you of our terms of service for using Moadaty platform. By using the Service, you agree to be bound by all terms defined hereinafter. If you do not agree to the terms of this Service, do not access Moadaty.

1. General Terms and Conditions

Moadaty is not an owner, vendor or operator of any Listings. Moadaty does not own, provide, rent, sub-rent, manage and/or control Listings. We urge users to review each rental list/request carefully, check owner/renter reviews, information and ensure proper identification are shown and validated during gear pickup and returns.

Identity verification and profile badges: identity verification and verified member profile badges, enable us to ensure a secure and trustworthy Service for all users. You promise to provide complete and accurate information and documentation. Moadaty has the right to conduct screening and background checks on the identity and users background.

Moadaty Roles: Moadaty roles and responsibilities are limited to the following:

  • Facilitating the availability of the Service
  • Facilitating the payment collection through a third-party payment provider while assessing applicable fees

As an Owner, you agree to grant Moadaty the right to allow the Renter use any Listings rented by them, as agreed to between you and the Renter. You understand and agree that Moadaty does not act as an insurer, broker, or as your contracting agent. Any agreement you enter into with any other User is between you and the User and Moadaty is not a party to it.

We reserve the right to withdraw or amend the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entire Service, to some or all users.

2. Payment and Processing Fees

All payments are made online via Credit Card and processed securely through Paytabs (PCI-DSS certified payment provider) .Each transaction includes processing fees (15%) in addition to VAT (15%) - where applicable - and subject to related banking fees.

3. Gear Listings and Insurance

Owners are responsible for creating their own Listings, and for the accuracy and content of their Listings. Owners must accurately describe the Listing and all of the Listing contents. Owners must only upload photos that accurately represent the Listing that they are offering to rent to a Renter.

Owners are responsible for setting a minimum coverage limit or accurate market value for their Listing “Insurance Value”. The Listing Insurance Value is displayed publicly on the Listing so that a Renter is aware of the Insurance Value prior to placing a rental request. Accordingly, the Owner agrees that Moadaty does not owe the Owner any amount for the repair or Insurance, and the final repair/insurance amount shall be determined by both the renter and gear owner jointly based on their assessment of the damages. Owners may adjust a Listing Insurance Value at any time, except for when a Listing has been requested by a Renter or in an active rental. Moadaty will keep track of any adjustments in the Listing Insurance Value.

4. Rental Period and Liability

The rental period is the period between when the gear owner releases the gear and when the renter returns the gear as defined in the rental request pickup date and return date of that gear listing on Moadaty. Any modification to the rental period must be made through Moadaty, and any modifications made without the acceptance of the gear owner are not authorized and may result in the owner or Moadaty making a police report against the renter and pursuing legal actions.

If the renter damages, steals, loses, transfer or fails to return the gear to the owner, within the Rental Period, agrees that they are liable and responsible to immediately pay the required repairs or Insurance value of the gear, up to the specific Insurance value mentioned in the listing.

5. Rental Rules

Rental Cancellation Policy: Renters can cancel a rental request before it is accepted. However, once the request had been accepted, if the renter cancels within 48 hours before the pickup date, they will receive a 50% refund. If the cancellation is within 24 hours of the pickup date, the rental is non-refundable.

Rental Pickup and Dropoff Times: Renters must pick up the rented gear after 2:00 PM on the rental pickup day and return gear by 12:00 PM on the dropoff day, unless both the Renter and the Owner agree to another time. Late rental dropoff fees may apply if any item is returned later than the agreed upon date and time.

Late Rental Dropoff Fees: Rentals dropped off after 12:00 PM on the dropoff day, or after the previously agreed upon time, are subject to a late drop-off fee that equals a one day rental fee (including the processing fees and VAT) for the Listing. The Renter must immediately pay any late dropoff fees.

Taking Rental or Sale Offline: The exchange of personal contact information before a rental request or offer has been accepted is not permitted. Any efforts to move rentals or sales initiated on Moadaty off-site to avoid fees is strictly prohibited and may result in account suspension or termination.

6. Property Rights

Moadaty is a GCC registered trademark and all the Service rights are reserved for Moadaty Inc., a legally registered company in Saudi Arabia under CR#1010478318.

Moadaty also reserves the right to any content held in its website, and these content can only be utilized with the written approval of the company.

7. Account Termination

Moadaty reserves the right to suspend or terminate users account that are in direct violation of our Terms of Service and Privacy Policy.

8. Content Standards

These content standards apply to all user contributions and use of the Service. User contributions must not contain the following:

  • Violent, harassment, descrimination hate or offensive language
  • Sexually explicit materials of any kind
  • Violates local laws or regulations
  • Conflicts with our Terms of Service and Privacy Policy

Moadaty reserves the right to remove offending contributions, and in some cases suspend or terminate the offending account.

9. Ratings and Reviews

After each completed rental transaction, members can leave a publically-listed review and rating on the gear and gear owner. Ratings or Reviews reflect the opinions of the individual members, and do not represent the opinion or views of Moadaty. In addition, Rating and Reviews are not verified by Moadaty and might be incorrect or misleading. Review content shall not contain any offensive or defamatory language, and Moadaty reserves the right to remove such comments subject to our content standards.

10. Information Accuracy

While we strive to have accurate and reliable information. We are not responsible, or liable to you or any third-party, for the content or accuracy of any content and materials provided by third party users.

11. Privacy Policy

All information we collect, store and analyze on the Service is subject to our Privacy Policy, By using the Service, you consent to all points related to your information in compliance with the Privacy Policy.

12. Geographic Restriction

Modaty, Inc., the owner of the website, is based in the Kingdom of Saudi Arabia. As such, it abides by its related local laws and regulations, and currently the Service is restricted to users based on Saudi Arabia only in certain major cities.

13. Rental limited Liability

While Moadaty strives to ensure a seamless and safe experience for all users by requiring Insurance value information and user identity validation, gear related accidents might occur during the rental period. Moadaty bears no liability to either party as a result of any damage to the gear during its use, and the gear owner should file a complaint in the Platform and contact the rentee to resolve the matter.

14. Complaints Time Limitation

There is a time limit to file complaints during or after rental had been completed. A complaint must be filed within a maximum of (3) months after the rental period had ended. Any claims made after that due date is considered expired.

15. Changes to This Terms of Service

We may update our Terms of Service from time to time. We will notify you of any changes by posting the new Terms of Service on this page. You are advised to review this Terms of Service periodically for any changes. Changes to this Terms of Service are effective when they are posted on this page.
